Terms of Service

These Terms of Service (the “Terms”) govern your use of the TinyLift mobile application, related updates, and this website (together, the “Service” for legal purposes in this document, while noting that the app and site may work differently) from TinyLift (also referred to as “we”, “us”).

1. A wellness app, not a medical service

The Service is intended as a wellness tool that offers small actions. It is not medical advice, mental health treatment, therapy, diagnosis, or crisis support. Do not use the Service for emergencies. If you feel unsafe, contact local emergency services or a crisis line in your area.

You understand outcomes vary by person and moment. We do not guarantee any particular feeling or result.

2. No promise of availability or uptime

We may update, change, or discontinue parts of the Service. We do not guarantee the Service will be available at all times, error-free, or free from issues beyond our reasonable control.

3. Accounts

TinyLift is designed to be useful without a TinyLift “account” as part of its normal experience, but certain platform features and purchases may require you to be signed in to your Apple ID or Google account to use the store, as set by the platform.

4. Subscriptions, purchases, and cancellations

If you purchase a subscription in the app, billing is managed by Apple and/or Google (and may involve store policies and, where applicable, a purchase SDK / provider). Your payment relationship is with the store platform under their terms. You can manage, change, and cancel subscriptions in your App Store or Google Play account settings, in line with the platform’s normal subscription tools.

We do not link to app listings here until the listings exist. When a purchase page or listing is available, it will be offered through the app stores, not a fake “download” page on the web.

To the maximum extent allowed by the platform and law, subscription fees may be non-refundable except as required by applicable rules and store policies.

5. License to use the Service

We grant you a personal, non-commercial, non-transferable, revocable license to use the Service, subject to these Terms, app store rules, and law.

6. Acceptable use

Do not use the Service to:

  • violate any law, infringe any third-party right, or harass anyone;
  • attempt to hack, scan, or probe systems you do not own without permission;
  • reverse engineer or try to extract source code, except as allowed by law;
  • misuse support channels (spam, abuse, or threats).

We may suspend or end access for violations, where we reasonably believe that is needed.

7. Intellectual property

The Service, including branding, text, design, and software, is protected by intellectual property rights. We own TinyLift and its content, except for third-party materials and open-source components used in normal ways, which remain under their own licenses.

Do not copy our name or brand in a way that is misleading about endorsing, sponsoring, or affiliating you with TinyLift, unless you have permission in writing for that specific use case.

8. User content

The Service is not designed to collect a large amount of your personal writing. If you email us, you grant us a limited right to use and store the email to respond and operate support, in line with our Privacy Policy.

9. Disclaimers

Disclaimer of warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, and any implied warranties that may arise by operation of law.

10. Limitation of liability

Liability cap

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service, even if we have been told of the possibility.

Our total liability for any claims related to the Service is limited to the greater of (a) the amount you paid us directly (not via a store) in the 12 months before the event (if any), or (b) twenty U.S. dollars (US$20), if (a) does not apply.

Some places do not allow these limitations; in that case, our liability is limited to the maximum amount permitted by law.

11. Governing law and disputes

These Terms are intended to be interpreted as written, but the laws that must apply in your home region may differ. You agree to try in good faith to contact support first. If a dispute is not resolved, you and we agree the courts in your home jurisdiction may be used where those courts have mandatory jurisdiction, unless required otherwise by a platform or applicable law. If a consumer protection rule in your area gives you more rights, those rights still apply to you to the extent required.

12. Changes to these Terms

We may update these Terms. We will post a new “Last updated” date when we do, and, where a change is important, we will try to show a reasonable notice in the app or on the site.
